Terms of Service

Welcome to Athlete Collective. These Terms of Service ("Terms") govern your access to and use of the Athlete Collective platform (the "Service"), operated by Athlete Collective ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Athlete Collective is a booking platform that connects youth sports coaches ("Coaches") with parents or guardians ("Parents") seeking training sessions for their children ("Athletes"). The Service enables Coaches to manage their availability, services, and bookings, and enables Parents to discover, book, and pay for training sessions.

Athlete Collective acts as a technology platform and is not a party to the coaching services provided. Coaches are independent service providers, not employees or agents of Athlete Collective.

2. Eligibility and Accounts

  • You must be at least 18 years of age to create an account.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Coach Terms

By registering as a Coach, you agree to:

  • Provide accurate information about your qualifications, certifications, and experience.
  • Maintain any licenses or certifications required by applicable law to provide coaching services.
  • Comply with all applicable laws and regulations related to working with minors.
  • Submit to background checks if requested by the platform.
  • Set availability honestly and fulfill confirmed bookings.
  • Treat all Athletes, Parents, and platform users with respect and professionalism.
  • Comply with the Athlete Collective Coach Code of Conduct.

Coaches are independent contractors and are solely responsible for their coaching services, including the safety of Athletes during sessions. Athlete Collective does not supervise, direct, or control coaching sessions.

4. Parent Terms

By registering as a Parent, you agree to:

  • Provide accurate information about yourself and your Athletes.
  • Disclose any relevant medical conditions, allergies, or special needs for Athletes.
  • Ensure Athletes are appropriately equipped and prepared for sessions.
  • Be available or designate a responsible adult for pickup and drop-off as needed.
  • Communicate directly with Coaches regarding any concerns about sessions.
  • Honor booking commitments and cancellation policies.

5. Bookings and Payments

Booking Process

  • Bookings are made through the Service by selecting a Coach, service, time, and location.
  • A booking hold is created when you select a time slot. Holds expire after 10 minutes if payment is not completed.
  • Bookings are confirmed upon successful payment processing.

Payments

  • All payments are processed through Stripe, our third-party payment processor.
  • Coaches receive payments directly through Stripe Connect, minus any applicable platform fees.
  • Prices for services are set by Coaches and displayed in the Service before booking.
  • A platform booking fee may apply and will be disclosed at checkout.
  • By making a payment, you authorize us to charge the payment method provided.

Cancellation and Refunds

  • Cancellations made more than 24 hours before a session are eligible for a full refund.
  • Cancellations made within 24 hours of a session may not be eligible for a refund, as determined by the applicable cancellation policy.
  • If a Coach cancels a session, the Parent will receive a full refund.
  • Refunds are processed through the original payment method and may take 5–10 business days to appear.
  • Rescheduling is available free of charge if requested at least 4 hours before the session.

Session Packages

  • Coaches may offer session packages (bundles of sessions) at discounted rates.
  • Package credits are non-refundable after purchase unless otherwise required by law.
  • Package credits may only be used with the Coach from whom the package was purchased.

6. Messaging

The Service includes an in-app messaging feature for communication between Parents and Coaches. You agree not to use messaging to send spam, harassment, offensive content, or solicitations for services outside the platform. We reserve the right to monitor messages for safety and compliance purposes.

7. User Content

You retain ownership of content you submit to the Service (profile information, photos, messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely in connection with operating the Service.

You agree not to submit content that:

  • Is false, misleading, or deceptive
  • Infringes on intellectual property rights of others
  • Contains offensive, abusive, or discriminatory material
  • Violates any applicable law or regulation

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Circumvent the platform to arrange bookings or payments outside the Service
  • Impersonate another person or misrepresent your affiliation
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other accounts or systems
  • Scrape, crawl, or use automated means to access the Service without permission
  • Harass, threaten, or intimidate other users

9. Background Checks and Credentials

Athlete Collective may facilitate background checks and credential verification for Coaches. However, we do not guarantee the accuracy, completeness, or reliability of background check results or credential verifications. Parents are encouraged to conduct their own due diligence when selecting a Coach. A background check badge on a Coach's profile indicates that the Coach has undergone a screening process, not that they are guaranteed to be safe or qualified.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of coaching services provided by Coaches on the platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETE COLLECTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

ATHLETE COLLECTIVE IS NOT LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES THAT OCCUR DURING OR AS A RESULT OF COACHING SESSIONS ARRANGED THROUGH THE SERVICE. COACHING SERVICES ARE PROVIDED BY INDEPENDENT COACHES, AND ATHLETE COLLECTIVE DOES NOT SUPERVISE OR CONTROL THESE SESSIONS.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Athlete Collective, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Intellectual Property

The Service, including its design, logos, text, graphics, and software, is owned by Athlete Collective and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations to pay for services already booked or received.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Athlete Collective regarding the Service and supersede any prior agreements.
